1. Introduction

1.1 Scope
These Terms of Service govern your access to and use of the MY LITY website and online shop. By accessing or using our website or purchasing products, you agree to these Terms.

1.2 Acceptance
By placing an order or using our platform, you confirm that you have read, understood, and accepted these Terms, including our Privacy Policy and Refund & Returns Policy. If you do not agree, you must discontinue use.

1.3 Amendments
 We may update these Terms from time to time. Updates take effect upon publication on this website and apply only to future orders. The version valid at the time of your order applies to that contract.


2. User obligations

By using our website or shop, you agree to:

  • Provide accurate, current, and complete information.

  • Comply with applicable laws and regulations.

  • Not misuse our website, attempt to hack systems, use stolen payment methods, or resell goods without our consent.

  • Ensure that your shipping address is correct; you are responsible for costs arising from incorrect or incomplete address details.


3. Products, pricing, and payment

3.1 Prices and currency
All prices are shown in Swiss francs (CHF) or euros (EUR), include statutory VAT where applicable, and exclude shipping costs (unless otherwise stated).

3.2 Payment
Payments are due immediately upon order. We accept the payment methods shown at checkout. Payments are processed securely through third-party providers; MY LITY does not store your credit card details.

3.3 Retention of title
 Goods remain the property of MY LITY until full payment has been received.


4. Orders and contract conclusion

4.1 Offer and acceptance
Product listings on our website are not legally binding offers but invitations to order.
By clicking the “Buy” button, you submit a binding order. You will receive an automatic confirmation of receipt, which does not yet constitute acceptance.
The contract is concluded only when we send you an order confirmation or dispatch the goods.

4.2 Refusal of orders
 We may refuse or cancel orders at our discretion, particularly in cases of unavailability, errors in pricing/description, or suspected fraud. Payments already made will be refunded.


5. Shipping and delivery

5.1 Delivery area
We currently deliver to Switzerland and EU countries. Any restrictions will be displayed at checkout.

5.2 Delivery time
In the EU, delivery must take place within 30 days of contract conclusion unless otherwise agreed.

5.3 Risk transfer
Risk of accidental loss passes to you once the goods are handed to the carrier, unless mandatory consumer law provides otherwise.

5.4 Delays
 We are not liable for delays caused by force majeure (e.g., natural disasters, strikes, pandemics, supply chain disruptions).


6. Refunds and returns

  • EU consumers have a statutory 14-day right of withdrawal.

  • Swiss consumers are granted a voluntary 14-day return right.

  • Refunds, returns, exclusions, and conditions are governed by our Refund & Returns Policy, which forms an integral part of these Terms.


7. Warranty and guarantees

7.1 EU consumers
You benefit from a 2-year legal guarantee of conformity under Directive (EU) 2019/771. Remedies may include repair, replacement, price reduction, or refund.

7.2 Swiss consumers
Warranty rights follow the Swiss Code of Obligations (Art. 197–210 CO), typically two years for movable goods, unless mandatory law provides otherwise.

7.3 Commercial guarantees
 Any additional warranties apply only if explicitly stated in writing and do not limit statutory rights.


8. Discounts and promotions

If we advertise a price reduction, it will be compared against the lowest price applied by MY LITY during the 30 days prior to the promotion, in compliance with the EU Omnibus Directive.


9. Intellectual property and user content

9.1 Ownership
All content on the MY LITY website (texts, images, logos, designs, software) is the property of MY LITY or licensors. Copying, distribution, or commercial use without prior written consent is prohibited.

9.2 User content
 If you submit content (e.g., reviews, photos), you grant MY LITY a royalty-free license to use and display it in connection with our services. You confirm you have the right to share the content and that it does not infringe third-party rights. We may remove user content at our sole discretion.


10. Limitation of liability

10.1 MY LITY is liable without limitation for intent, gross negligence, injury to life, body or health, and mandatory statutory claims (including product liability).
10.2 For slight negligence, MY LITY is liable only for breaches of essential contractual duties and limited to foreseeable, typical damages.
10.3 We are not liable for indirect damages, consequential losses, or lost profits to the extent permitted by law.
 10.4 In cases of force majeure, MY LITY is released from its obligations for the duration of the event.


11. Governing law and jurisdiction

11.1 These Terms are governed by Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
11.2 The place of jurisdiction is Aargau, Switzerland, unless mandatory consumer law in your country of residence provides otherwise.
